Washington wants to ban Chinese AI models. Open weights make enforcement impossible. Your supply chain audit starts now.

The Trump administration just revived its push to ban Chinese AI models.

Triggered by Moonshot AI's Kimi K3 — a 2.8-trillion-parameter open-weight model that beat Fable 5 and GPT-5.6 Sol in blind coding tests.

But here's the structural problem nobody in Washington wants to say out loud.

Open-weight models can't be banned like APIs.

Once Kimi K3's weights drop on July 27, any enterprise can download them, run them air-gapped in a private data center, and regulators will never know.

The Commerce Department considered adding DeepSeek and other Chinese AI labs to the Entity List. That option is back on the table.

But Entity List restrictions target chips and cloud access — not files that already live on your server.

David Sacks is right about one thing: "This is how you lose the AI race."

He's warning that banning Chinese models hands a monopoly to OpenAI and Anthropic — the only two companies with the scale to absorb the demand.

Coinbase is already running GLM-5.2 and Kimi in production. They cut AI spending nearly in half.

The enforcement gap is the real story. Federal procurement rules can stop agencies from using Chinese models. Security advisories can make boards nervous.

But they can't delete weights that are already downloaded.

Audit every AI model in your stack — including developer tools, third-party integrations, and internal applications — for Chinese-origin open-weight components.

Document adoption dates and business justifications now, before retroactive compliance obligations land.

Update your model intake policy to require country-of-origin disclosure.
