The EU AI Act just got teeth. Today.

The EU AI Act's enforcement powers go live today, August 2.

The Commission can now fine general-purpose AI providers up to €15 million or 3% of global turnover.

This is not a drill. Article 50 transparency obligations are also live: chatbots must disclose they're AI, deepfakes must be labeled, synthetic content must carry machine-readable marks.

The Digital Omnibus deferred high-risk obligations to 2027 and 2028. It did NOT defer Article 50 or GPAI enforcement. If your compliance team read "the EU delayed the AI Act" and breathed a sigh of relief, they misread the headline.

The Commission is already in direct bilateral talks with OpenAI and Anthropic over the rogue agent containment failures. Both companies briefed Brussels before the incidents became public. Neither has been formally accused yet, but the engagement signals that enforcement will not wait for perfect evidence.

190 organizations signed the Code of Practice on Transparency. Signing shifts enforcement toward adherence monitoring. Not signing means you carry the burden of proving your own approach is adequate to national market surveillance authorities.

If your product presents AI-generated outputs to EU users, you are a deployer under Article 50 regardless of where your company is incorporated. Your obligations are separate from your foundation model vendor's. They are independently enforceable.
