The catch: when an incident happens, OpenAI has nothing to hand you.

No session logs. No prompt history. No forensic record. The behavioral signals they send are narrow alerts — not evidence. If a regulator asks what happened in that AI interaction, you produce the logs or you don't answer.

This is a forensic responsibility transfer disguised as a privacy feature.

Meanwhile, Anthropic went the opposite direction. They now require 30-day data retention for business customers using their most capable models. The reasoning: cross-session pattern detection — the exact capability OpenAI claims to replicate without logs — requires actual data.

Neither solves your compliance gap. OpenAI's model shifts the burden to your infrastructure. Anthropic's model creates retention obligations your legal team may not have approved. And both leave you exposed if you haven't built internal AI audit logging that can stand alone.
